1. Acceptance
These Terms govern access to and use of the My Nail Art Chrome extension, website, Capture Studio, side panel, My Studio dashboard, 10 Nail Set editor, inspiration library, Settings, Appointment Passport exports, and related features. My Nail Art is published by JerseyPublishers.
By installing, accessing, or using My Nail Art, you acknowledge that you have read and understood these Terms and agree to them. If you do not agree, do not install or use My Nail Art; if installed, discontinue use and uninstall it through Chrome.
2. Eligibility and minors
You must be legally capable of entering into these Terms where you live. A user below the applicable age of legal capacity may use My Nail Art only with the permission and supervision of a parent or legal guardian.
Parents and guardians are responsible for supervising a minor's browser captures, imports, saved designs, support messages, exports, and sharing. My Nail Art is a general-audience creative planning tool and is not specifically directed to children under 13.
3. Description and single purpose
My Nail Art helps users deliberately capture or import visual nail inspiration, save and organize it locally, customize a complete ten-nail set, prepare an Appointment Passport, and export or share user-controlled design references.
The application is a communication and creative-planning aid. It does not guarantee that any design can or will be reproduced exactly by a nail professional.
4. No account, payment, or subscription
Version 4.1.5 does not require an account, login, payment, or subscription and is offered free of charge. Installing My Nail Art does not create a financial, salon, membership, or professional-service relationship.
JerseyPublishers may introduce, modify, or discontinue features or separate products in the future. Any future charge will be clearly disclosed before a user is billed.
5. Local-first operation and backups
Confirmed captures, imported images, designs, notes, boards, settings, and related application information are stored locally in the user's Chrome profile. My Nail Art does not provide developer-operated cloud storage, synchronization, or guaranteed backup.
JerseyPublishers cannot access, recover, restore, or remotely delete information stored only on a user's device. Users are responsible for device security, storage limits, protecting exports, maintaining backups of important work, and understanding that clearing Chrome data, deleting a profile, or uninstalling the extension may permanently remove local information.
6. Permission to use My Nail Art
Subject to these Terms, JerseyPublishers grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable permission to install and use My Nail Art for lawful personal, creative, appointment-planning, client-communication, or professional-reference purposes.
This permission does not transfer ownership of My Nail Art. You may not sell, rent, lease, sublicense, redistribute, or commercially exploit the extension itself without prior written authorization. Nail professionals may use it for lawful client communication and design reference.
7. User content
User Content includes captures, images, designs, notes, colors, shapes, project files, boards, stylist instructions, source references, and other material a user captures, imports, creates, saves, exports, or shares. You retain rights you already possess in your original User Content, and JerseyPublishers does not claim ownership of locally created designs or notes.
You are responsible for your User Content and for determining whether you have the right to capture, import, edit, save, export, publish, or share it.
8. Website captures and third-party rights
Websites, photographs, logos, patterns, illustrations, characters, products, trademarks, and other third-party material may be protected by copyright, trademark, privacy, publicity, contract, or other rights. Capturing material does not grant ownership or permission to use it.
You agree to respect website terms and access restrictions; obtain permission when required; avoid confidential or private information; avoid misrepresenting another person's work; and not use My Nail Art to bypass paywalls, access controls, browser protections, or applicable law. JerseyPublishers does not decide whether a particular use is fair use or otherwise legally permitted.
9. Sensitive visible information
A visible browser capture may incidentally include personal, confidential, copyrighted, financial, medical, authentication-related, or otherwise sensitive information. Review every capture before saving or sharing it and crop, cancel, or delete anything not intended for retention or disclosure.
- Do not capture or share passwords, authentication codes, payment-card or financial information.
- Do not capture private messages, medical records, identification documents, confidential business information, or another person's information without authorization.
- JerseyPublishers cannot inspect or remove locally stored captures from a user's device.
10. Clipboard and imported files
Clipboard image access is optional and occurs only after the user selects Paste and grants the applicable permission. Users are responsible for verifying that the intended image is on the clipboard.
Users are responsible for imported files, including their content, origin, safety, rights, and compatibility. My Nail Art may reject or resize unsupported, malformed, excessively large, or potentially harmful files. Do not import malware, executable code, corrupted files, or material intended to disrupt the application or browser.
11. Designs and Appointment Passports
Designs and Appointment Passports are illustrative references. Actual salon results may differ because of nail size and condition, materials, equipment, technician interpretation, appointment duration, lighting, display or print differences, substitutions, allergies, sensitivities, or safety considerations.
JerseyPublishers does not guarantee that a professional will accept, understand, reproduce, or complete a design exactly. Discuss feasibility, timing, materials, price, substitutions, and safety directly with the nail professional before service.
12. No medical or professional advice
My Nail Art is a creative design and communication tool. It does not provide medical, dermatological, allergy, infection-control, legal, financial, or other professional advice and does not diagnose or treat any condition.
Consult a qualified healthcare professional about pain, swelling, infection, allergic reaction, damaged nails, or skin conditions. Consult a qualified nail professional about product safety, sanitation, application, removal, and design suitability. Do not delay professional advice because of information displayed by My Nail Art.
13. Translation assistance
Translated interface text, bilingual labels, or short phrase assistance may be incomplete, approximate, unavailable, or inaccurate. My Nail Art is not a professional translation service. Review original wording and use a qualified interpreter or direct professional communication for important health, safety, allergy, legal, or contractual information.
14. Exporting and sharing
Users may export or share PNG images, SVG files, printable views, Appointment Passports, editable project files, and backups. Users are responsible for choosing and confirming recipients, reviewing files, protecting sensitive information, maintaining backups, deleting unwanted copies, and ensuring they have the right to share included material.
After a user sends a file to another person, application, printer, website, storage provider, or communication service, that recipient may process it under its own terms. JerseyPublishers does not control destinations selected by the user.
15. Acceptable use
Use My Nail Art only for lawful purposes. You may not infringe rights; violate privacy, confidentiality, or contracts; harass, threaten, exploit, or impersonate anyone; distribute unlawful or malicious content; capture private information without authorization; distribute malware; damage the extension; circumvent Chrome protections or website access controls; remove proprietary notices; falsely claim affiliation with JerseyPublishers, Google, or Chrome; or use automated systems to abuse the application or support services.
JerseyPublishers may restrict JerseyPublishers-operated support services or discontinue support for users who misuse those services, subject to applicable law.
16. Ownership and feedback
My Nail Art's software, interface, original graphics, mascots, branding, icons, layouts, and written materials are owned by JerseyPublishers or its licensors and protected by applicable law. These Terms do not grant permission to copy, sell, publish, redistribute, or create a competing derivative product from proprietary assets except where law expressly permits.
JerseyPublishers may consider and use voluntarily submitted ideas or feedback without compensation or obligation. This does not transfer ownership of a user's private designs, captures, or locally stored content. Do not submit confidential business information as general feedback.
17. Third-party products
My Nail Art may interact with Chrome, the Chrome Web Store, websites chosen by users, local file systems, native sharing interfaces, printers, communication applications, salons, and storage providers. Those products and services are governed by their own terms and privacy policies.
A link or interaction does not mean JerseyPublishers endorses or controls a third party. Google and Chrome are not parties to these Terms and do not sponsor or endorse My Nail Art.
18. Support and privacy
Support is available at https://mynailart.jerseypublishers.com/#support and by email at info@jerseypublishers.com. JerseyPublishers will make reasonable efforts to review requests but does not guarantee a response time, solution, update, or recovery of local information.
Use is also governed by the Privacy Policy at https://mynailart.jerseypublishers.com/#privacypolicy. Do not include passwords, payment information, authentication codes, private communications, confidential files, or unredacted sensitive captures in support messages.
19. Updates, availability, and termination
JerseyPublishers may add, remove, modify, secure, or discontinue features; correct defects; change file-format or browser requirements; and deliver updates through the Chrome Web Store. Material changes to information handling will receive legally required disclosures and choices.
My Nail Art depends on compatible Chrome features including Manifest V3, side panels, extension storage, IndexedDB, active-tab access, and scripting. Some protected pages cannot be captured. Continuous availability or compatibility with every browser, Chrome release, operating system, website, file, printer, sharing destination, or enterprise policy is not guaranteed.
Users may stop using My Nail Art and uninstall it at any time. Uninstalling may permanently remove local information, so export important projects first.
20. Disclaimer of warranties
To the fullest extent permitted by law, My Nail Art is provided “as is” and “as available,” without express, implied, or statutory warranties. JerseyPublishers disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and compatibility to the extent legally permitted.
JerseyPublishers does not warrant uninterrupted or error-free operation, successful exports, permanent local storage, capture on every website, accurate translation, exact salon reproduction, correction of every defect, or indefinite availability. Mandatory consumer rights remain unaffected.
21. Limitation of liability
To the fullest extent permitted by applicable law, JerseyPublishers and its owners, employees, contractors, licensors, affiliates, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from My Nail Art, including local data loss, export loss, device or browser issues, translation errors, salon outcomes, user-selected sharing, third-party content, copyright or privacy disputes, health conditions, or another person's conduct.
Where liability cannot be excluded, total liability will be limited to the greater of the amount paid directly to JerseyPublishers for My Nail Art during the twelve months preceding the claim or ten U.S. dollars, except where applicable law requires another remedy. Some jurisdictions do not allow particular limitations, so they apply only to the maximum legal extent.
22. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless JerseyPublishers and its owners, employees, contractors, licensors, affiliates, and service providers from claims, losses, liabilities, damages, and reasonable expenses arising from unlawful use, violation of these Terms, User Content, infringement of rights, misuse of exports, or violation of law. This does not require indemnification for conduct attributable solely to JerseyPublishers where prohibited by law.
23. Governing law and informal resolution
These Terms are governed by the laws of New Jersey and applicable United States law, without regard to conflict-of-law principles, except where mandatory consumer law in the user's residence applies. Subject to non-waivable consumer rights, disputes will be brought in a court of competent jurisdiction in New Jersey.
Before filing a claim, the parties will make a reasonable effort to resolve it informally. Send a concise description and requested resolution to info@jerseypublishers.com, without passwords, payment credentials, authentication codes, or unrelated sensitive information. This does not prevent urgent injunctive relief or use of a legally available consumer complaint process.
24. General legal terms
If a provision is invalid or unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue. Failure to enforce a provision is not a waiver. Users may not assign these Terms without prior written permission; JerseyPublishers may assign them with a merger, acquisition, restructuring, transfer, or asset sale subject to law and required notice.
These Terms and the Privacy Policy form the entire agreement concerning My Nail Art unless a separate written agreement expressly applies. Sections concerning ownership, responsibility, disclaimers, liability, disputes, and third-party rights survive termination where their nature requires.
25. Changes and contact
Updated Terms will identify a new effective date and be posted at https://mynailart.jerseypublishers.com/terms. Continued use after an update constitutes acceptance where permitted; additional notice or agreement will be requested when required by law.
